Sia's estranged husband Dan Bernad has been denied sole custody of their son after filing an emergency order earlier this week.
According to court documents obtained by PEOPLE, the "Chandelier" singer's estranged husband has been denied custody of their 19-month-old son Somersault, with the judge ruling that there wasn't sufficient evidence to constitute an emergency order.
"The court finds that sufficient exigency for the requested emergency relief has not been shown at this time," the filing read. "The parties entered into a stipulated legal custody and interim physical custody arrangement on August 1, 2025. Most of the facts asserted in Respondent's RFO were known at that time."
The two will operate under the previous custody arrangement, which gives Sia primary custody of Somersault and allows for limited and monitored visitation for Bernad.
A rep for Bernad did not immediately respond to PEOPLE's request for comment.

The ruling comes after Bernad claimed the singer is "an unfit and unreliable parent struggling with substance abuse and addiction" in court documents filed on Monday, Oct. 27, and obtained by PEOPLE on Tuesday, Oct. 28.
However, in Sia's responsive declaration, filed on Oct. 28 and obtained by PEOPLE, the singer claimed she's been sober for six months.
"I have been fully sober for over six months and working my program which includes weekly testing and a sober companion," the filing read. "My recovery has been a cornerstone of my life and one of the primary reasons I chose to separate from Dan, whose ongoing engagement in a nightlife and recreational drug-use lifestyle is incompatible with a healthy environment for our child."
Bernad also alleged that Sia did not take a "primary caregiving role" with their son, whom they call Summi, adding that she "delegated nearly all child-rearing responsibilities to a revolving team of nannies while she maintained control from a distance."
In response to his claims, Sia alleged that her son "has always been in my primary care and custody," adding that Bernad has never "had custody of Summi for more than two hours at a time and [was] always monitored" from the onset of a criminal investigation for possessing child pornography by the LAPD and the Department of Child and Family Services.

Although she acknowledged that she understands that the investigations have been inconclusive and closed, Sia stated that it "does not appease my concerns of Summi spending unsupervised time with Dan."
In addition to sole custody, Bernad requested Sia to submit to regular drug testing, enroll and participate in co-parenting classes for six months and have monitored visitation three times per week for two hours.
Bernad, who claimed that he is currently unemployed and doesn't have an income, also asked for $77,245 per month in child support and for her to be fiscally responsible for all uninsured medical expenses, extracurricular activities, tuition and childcare costs.
The singer — who adopted two 18-year-old boys in 2019 — claimed in her filing that she believes Bernad is financially motivated, and that she has already paid him $300,000 since they split in March.
“To date, every request by Dan for additional custodial time has been directly tied to financial gain rather than a genuine effort to foster a meaningful parental relationship with Summi,” she wrote.
